The owner of a sports bar in Delmar is facing criminal charges after police allegedly found four illegal gambling machines on the premises.
James F. Daley, the 55-year-old owner of The Sports Nut Restaurant & Pub at 8 N. Pennsylvania Ave, was arrested at the establishment on Saturday, according to Delaware Division of Alcohol and Tobacco Enforcement (DATE) spokeswoman Kimberly Chandler.
His arrest followed an undercover investigation into illegal gambling at the bar that had been prompted by a complaint, she said.
During the investigation, officers discovered two video gambling machines in the bar area and witnessed a customer receive a cash payout from the bartender, Chandler said.
DATE executed a search warrant at the restaurant on Saturday and reportedly found patrons playing two more illegal gambling machines in a private smoking area near the kitchen.
During the raid, the officers seized the four illegal gambling machines, financial records and $733 in cash.
Daley is charged with possession of a gambling device and providing a premises for gambling.
He later was released on a $750 unsecured bond.
Chandler said the investigation is ongoing and additional arrests are anticipated.
